The federal court for the Northern District of New York granted a pre-discovery motion to dismiss a civil rights claim brought by a landlord who advanced multiple constitutional claims following the City’s attempts to enforce its local rental ordinance. The District Court granted the motion filed by April Laws and Gregg Johnson on multiple legal grounds, including a finding that the City’s Ordinance was not unconstitutionally vague. Plaintiff’s appealed this ruling to the US Court of Appeals for the Second Circuit, where the lower Court’s decision was affirmed (2019 U.S. App. LEXIS 8698).
