Baker v. Spinner, No. 8:18-cv-00950 (BKS/DJS), 2019 U.S. Dist. LEXIS 126541 (N.D.N.Y. July 30, 2019)

On July 30, 2019, the federal district court for the Northern District of New York granted Defendants’ motion for judgment on the pleadings and dismissed Plaintiff’s Complaint advancing claims of malicious prosecution and violations of his Fourth, Fifth, Eighth, and Fourteenth Amendment rights against a County probation department and certain probation officers, and “failure to intercede” on behalf of Plaintiff against each of the individual officers named.  The Court granted the motion by attorneys Gregg Johnson and Loraine Jelinek, dismissing Plaintiff’s Complaint in its entirety.  (Plaintiff has appealed this decision.)
