McLoughlin v. Rensselaer Cty. Dep’t of Soc. Servs. (2019 U.S. Dist. LEXIS 137120 [NDNY 2019])

On August 14, 2019, the federal district court for the Northern District of New York granted Defendants partial dismissal of most claims brought by parents of a minor child resulting in actions taken by DSS Caseworkers regarding their child.  The lawsuit advanced several civil rights claims.  The Court dismissed all claims against the Rensselaer County Department of Social Services (“County”); and also dismissed Plaintiffs’ Eighth Amendment, malicious prosecution, equal protection, and substantive due-process claims against all of the remaining individual Defendants.
