Gregg Johnson successfully appealed an Order denying portions of their summary judgment motion. This complaint was brought by a nursing student who challenged her dismissal from the school’s nursing program due to poor performance. Ms. Jelinek and Mr. Johnson filed a post-discovery motion for summary judgment, which was granted in part and denied in part. Upon appeal, the Appellate Division Third Department found that the lower court erred, reversed the lower court’s decision, and dismissed the Complaint, ending the litigation against Johnson and Laws’ clients.
