Keller v Schoharie County Dept. of Social Servs. (2021 U.S. App. LEXIS 15025 [2d Cir. 2021])

Plaintiff filed a Complaint in the United States District Court for the Northern District of New York, seeking various damages from the County for alleged violations of Plaintiff’s due process and privacy rights, among other federal claims.  Our team filed a Rule 12(b) motion to dismiss on behalf of the Defendants and, in response, Plaintiff filed a motion seeking to amend the Complaint.  On March 27, 2020, the Court granted the County Defendants’ Motion to Dismiss, denied Plaintiff’s motion to amend her Complaint, and dismissed the case in its entirety.  Our team successfully defended Plaintiff’s appeal of the Decision and Order to the United States Court of Appeals for the Second Circuit.
