Plaintiff filed suit in Supreme Court of the State of New York for Ulster County against multiple defendants, including Columbia County, for which Plaintiff sought, inter alia, a declaration of a third-party’s Medicaid eligibility, along with unspecified monetary damages for alleged negligence. Prior to conducting party depositions, our team filed a motion seeking complete dismissal of all claims against Columbia County, which was granted by Decision and Order, dated April 7, 2021. Plaintiff appealed this order and the lower court’s decision was affirmed.
