Logan v. Clifford (2021 U.S. Dist. LEXIS 183950 [NDNY 2021])

Gregg Johnson obtained complete summary judgment on a civil rights action alleging that multiple City of Schenectady Police Officers were deliberately indifferent to Plaintiff’s medical needs in violation of the Fourteenth Amendment; Plaintiff also brought state law claims for negligence and intentional infliction of emotional distress. The Court found that, although Plaintiff was shot twice by police officers at his home, there was no evidence that any defendant acted with culpable recklessness and that the defendants were nonetheless been entitled to qualified immunity. All claims were dismissed prior to trial.
