The New York Appellate Division for the Fourth Department affirmed summary judgment dismissal of multiple claims brought by a former County staff member. In October 2016, following a week-long jury trial defended by Gregg Johnson, the jury returned a unanimous defense verdict dismissing all of Plaintiff’s remaining (retaliation) claims. Following the verdict, the Herkimer Supreme Court granted Mr. Johnson’s motion for prevailing party attorneys’ fees in 2017, awarding one of the firm’s clients $15,000. Plaintiff’s post-verdict motions were appealed to the Fourth Department.

New York Appellate Division for the Fourth Department affirmed the lower court’s order denying Plaintiff’s motion for a new trial (and reversed the lower court’s order granting prevailing party attorneys’ fees) finally-resolving a protracted litigation in favor of Mr. Johnson’s four clients.
